With regard to the legal significance of the inspection, reference is made to the commentary on VOB Part C - Landscaping Work: “The careful and thorough performance of inspections is an explicit obligation of the Client as part of its construction supervision. Only through these inspection checks can a proper assessment of the contractual quality of the contractor’s work be made, thereby creating the prerequisite for a proper acceptance. If existing defects are not identified prior to or at the time of acceptance due to omitted or incomplete inspection checks, the Client bears the full burden of proof for defects that become apparent after acceptance.”
